The SBI sent a suspect to Poland to hand over to the former acting head of Ukravtodor

On January 4, 2021, the State Bureau of Investigation (SBI) sent a written notice to the competent authority of the Republic of Poland on suspicion of handing over the former acting head of the State Agency of Motor Roads of Ukraine “Ukravtodor”, who is under arrest. We are talking about Slavomir Novak, who headed Ukravtodor during 2016-2019, and in October 2016 received Ukrainian citizenship.

According to the message on the SBI website, the acting The head of the State Agency of Motor Roads of Ukraine is suspected of intentional failure to perform official duties as a person who held a particularly responsible position, failure to comply with court decisions and rulings that entered into force, and obstruction of their implementation (Part 3 of Article 382 of the Criminal Code). The sanction of the article provides for imprisonment for a term of 5 to 8 years with deprivation of the right to hold certain positions or engage in certain activities for up to 3 years.

“It was established that during 2017-2019 the official intentionally did not comply with the decision of the local and Supreme Courts of Ukraine to reinstate the head of the Road Service in one of the regions of Ukraine and actively obstructed the implementation of these decisions. As a result, fines were imposed on the State Agency of Motor Roads of Ukraine and the said official was warned about criminal liability for non-compliance with court decisions, ”the statement reads.

On September 3, 2019, the enforcement proceedings were completed and a report on the commission of a criminal offense was sent to law enforcement agencies. A few weeks later, Novak resigned voluntarily, left the borders of Ukraine and returned to the Republic of Poland, where he was detained for a number of serious corruption offenses. In particular, Mr. Nowak is suspected of setting up enterprises in Poland, the authorized capital of which was created at the expense of illegal profit, which was transferred from Ukraine either in cash or through third parties.

According to the Polish Gazeta Wyborcza newspaper, Nowak is suspected of corruption, money laundering and leading an organized criminal group.

Investigation into corruption by the former acting the head of the State Agency of Motor Roads of Ukraine is held jointly by the Central Anti-Corruption Bureau of Poland, the District Prosecutor’s Office in Warsaw, the Special Anti-Corruption Prosecutor’s Office in Kyiv and the National Anti-Corruption Bureau of Ukraine.

Sławomir Nowak, the former head of Ukravtodor and a Polish citizen, is currently being held in a detention center. In January 2021, the court must consider his further arrest for the duration of the ongoing investigation.
