In November the company of the scandalous developer Volodymyr Zubyk – Intergal-Bud – resumed construction work in the UNESCO buffer zone. In order to avoid possible conflicts with local residents and representatives of regulatory authorities, a minibus with young sportsmen quickly went to the scene.

What do we know?

Construction work has resumed on the construction site of the residential complex “Kyiv Switzerland”, which is located on the street Makarivska, 3-5 in the Shevchenkivskyi district of the capital. The construction is actively opposed by the local community, which has already stopped work on the site several times (read more about this in our article: In the UNESCO protection zone near the St. Kirillovskaya Church, developers are cutting down trees again).

According to the Urban Cadastre of Kyiv, the area occupied today for construction is located in the protected area of the World Heritage Site – ” St. Kirillovskaya Church”, which is part of the historical and cultural reserve ” The Sophia Cathedral”. According to the information posted on the official website of the developer, the customer of the construction is the company “Intergal-Bud”, the work is performed by PE “Construction Company “SOMPEX “.

The Ministry of Culture refused to approve the project documentation for the developer

In May 2020, the Ministry of Culture and Information Policy of Ukraine did not approve the contractor PE “Construction Company” “SOMPEX “documentation for the construction of a residential complex, in particular – earthworks. Earlier, in the spring of this year, at the request of the deputy of the Kyiv City Council – Svyatoslav Kutnyak, the developer’s card for violation of landscaping for construction work was canceled. In turn, the Department of Urban Development of the executive body of the Kyiv City Council (Kyiv City State Administration) has undertaken to dismantle the illegally installed fence as soon as possible.

However, immediately after the end of the local elections in Ukraine, the situation changed somewhat. At least, the position of the city authorities on the illegality of construction in the protected area of the World Heritage Site has become less stable. The fence has not been dismantled yet, and the city council probably did not plan to apply sanctions against the unscrupulous user of the land plot.

So, the developer began to act alone, so to speak, “in advance.” On the morning of Wednesday, November 25, the builders of SOMPEX came to the construction site again, though this time not by themselves. The developer decided to take with him a support team of up to 20 people.

The young men of athletic build were in black and behaved quite defiantly. Some of the most active always tried to get into a verbal altercation with the locals, the other – mostly stood aside, covering the fence. When asked about the reasons for their stay next to illegal construction, men answered differently. Versions of “athletes” ranged from “just walking Tatarkai” to “came to count the health of the regional hospital.” The equidistance of these two objects from the construction site is more than a kilometer, however, the guests in black did not remove anything.

However, the presence of such a large number of strangers on a quiet and inconspicuous street in the private sector worried locals and activists, so a police squad was soon called.

“Yes, the Ministry of Culture” did not approve “our documents for construction. So this is not a building. I will now explain – the construction involves several stages. Now – the first step: the construction of a retaining wall, which we do and do not violate anything, “- assured the audience a representative of the developer Sergei Altynnikov.

By that time, the confrontation on Makarivska Street had already reached a boiling point. It is not surprising – despite the arrival of two police squads, construction work continued. So people were ready to literally “take the construction fence by storm.”

“Police, on what grounds are the works being carried out here? What are we going to play in the circus here? ”Public activist Oleh Symoroz addressed the police. However, probably, this question has already automatically acquired a rhetorical color for law enforcement officers. After all, at first, the police transferred the request to intervene and stop the illegal actions to colleagues: “Now the investigative task force will come, it will understand …”. And then in general translated the direct requirement of the law to terminate any full-fledged actions into a verbal pun: “Then show me how to get in!”

“Let’s figure it out“

In the end, Kyiv activists and the community simply had to “push” the police behind the construction fence, which, however, did not bring the desired result. Law enforcement officers took the explanations from the foreman and the developer’s representative, but they did not obstruct any illegal construction works, despite the open criminal proceedings.

The police left, and the “sick athletes” remained

The same applied to young sportsmen, who after a short oral conversation with the cops temporarily disappeared somewhere, but, as it turned out, – for a short time… State of emergency in the Shevchenkivskyi district. However, its arrival had little effect on the situation. Everything is standard and banal for our time – the developer, who is breaking the law, was politely invited to provide a separate explanation, and after the departure of the police, the “athletes” in black returned to the site.

Instead of an epilogue

The trend with the actual inaction of Kyiv’s law enforcement agencies in stopping illegal actions cannot but be alarming. And if earlier – inaction of cops was limited not by simple departure on a call, and even conscious ignorance of reports on violation of the law, now actions (inaction) of police officers more and more take shape of integral system. Police – does not know, does not see, does not hear about illegal construction works not all over the capital, the principle of passive response (active non-interference) of militiamen is traced while on such objects as: Metrological, 7, Lviv-Painting, Makariv, 3- 5…, etc. However, how !!? The results of unauthorized construction works are – broken seals of property seizure, attempts to detain activists, “educational conversation” with crime…
