The Economic Court of Kyiv will determine the fate of the historically and culturally designated land near the Pirogovo Museum

On Wednesday, January 13, at 10:20 AM, a decisive hearing will take place in the Economic Court of Kyiv regarding the development of lands near the National Museum Pirogovo. The case concerns historically and culturally designated lands around the National Museum of Folk Architecture and Life of Ukraine.

«At first – the first section with an area of ​​16 hectares, then – all the others, in total – about 240 hectares, will be covered with modern high-rises, enclosing the Pirogov Museum in a concrete ring – everything as outlined in the so-called ‘conceptual agreements’ seized during the search by SBU officers from Kyiv overseer Komarnytsky and published by D. Bigus! So, tomorrow the court, at the suit of the prosecutor’s office against the customer of the construction of the agricultural limited liability company «Agrokombynat Khotivsky» – these are our oligarchs Vasya Khmelnytsky + Andriy Ivanov! In the context of our story, we are more interested in the latter…,» – wrote Kyiv activist Mykhailo Pohrebyskyi on his Facebook page regarding this matter.

The capital prosecutor’s office has filed several lawsuits with the Economic Court of Kyiv to cancel the lease rights for lands located in the protected zone of the National Museum of Folk Architecture and Life of Ukraine. Initially, they are trying to reclaim over 60 hectares of land valued at 1.2 billion UAH for the city.

In the middle of 2020, Kyiv Local Prosecutor’s Office No. 1 filed lawsuits with the Economic Court of Kyiv to cancel the decisions on state registration of lease rights for 6.5 hectares of land worth 95 million UAH, located on Akademika Zabolotnoho Street within the protected zone of the National Museum of Folk Architecture and Life of Ukraine. The prosecutor’s office reported that it was established that in 2017, the agricultural society illegally registered the right to use the specified land plots. Since the land plots belong to municipal property, and the Kyiv City Council did not make a decision to lease them, the prosecutor’s office filed lawsuits to cancel the decisions on state registration of lease rights for land plots by a private structure.

Currently, lacking legally registered lease rights for these land plots in the Unified State Register of Rights to Immovable Property, but covering up with urban planning conditions and restrictions on the construction of an 8-block residential complex, ‘Agrokombynat ‘Khotivsky’ can at any time begin preparatory work on lands with protective status.

«About a year ago, these preparatory works already started with the destruction of part of the forest on the land plot with cadastral number 8000000000:79:107:0002 with an area of ​​16.0345 hectares – and further actions of the developer were stopped by the judge’s ruling on securing the claim in case No. 910/5217/20, which FORBADE any actions on the plot! With the closure of this case, of course, the ban on work will be lifted!,» – believes Pohrebyskyi.
