On Friday, October 5, for the first time in Kyiv, representatives of initiative groups against the destruction of historic Kyiv, destruction of recreational and green areas, and deterioration of living conditions gathered at a roundtable in the building of the National Union of Journalists of Ukraine together with the Deputy Prosecutor of Kyiv Serhiy Repetsky, architects Gleba V. and Duzhev S, Head of the Department of Cultural Heritage O. Nikoriak and Head of a department of the Ministry of Regional Development A. Ponomaryov. At the conference “Demolitions – reasons, effects and ways to solve the crisis” they outlined the first stages on the way to solving the most acute problem of Kyiv and its suburbs.

Independent expert of public administration in the field of urban planning, corresponding member of the Ukrainian Academy of Architecture, assistant professor of the Boychuk Kyiv State University of Architecture and Construction, Viktor Gleba, on the example of the Pokol tract development, told how licensed experts do not notice violations of laws and regulations.

Everything is on fire and sinking. Kyiv lived to see us turn from a capital into a shithole. I want to show you a fragment of the DPT, which the prosecutor spoke about.

In the urban development plan, it is visible – from the kindergarten to the burning restaurant in Novopecherski Lypky, it’s 9 meters and 56 centimeters. Let’s open the state construction norms: it says there – 25 meters from the fence of the kindergarten to the facade of the nearest building. And the prosecutor needs to prove in courts, in some higher courts, maybe even in The Hague, to prove that state construction norms are necessary for compliance.

We need to analyze not the consequences. I want to talk and show who is responsible for this inaction, who pushes us the community to protest. It is precisely the irresponsibility of the DABi that has led to what we see today in Kyiv, the so-called “Kyiv Syndrome”.

Besides the fire, besides the danger of physical destruction, Kyiv is faced with the problem of environmental crimes and an environmental disaster. These vigilant storms on the Left Bank are not the result of some cataclysms, but the result of the fact that Kyiv no longer has a green belt. The forest is already being completely cut down. This is done by representatives of all political parties sitting in the Kyiv City Council. I no longer believe in any of them. There is no opposition there. No one supports the community. Therefore, we are obliged to fight lawlessness on our own.

I want to demonstrate the inaction of the SACI and the toothlessness of investigators using a specific example. This is the Pokol tract, which has been recognized as a nature conservation site and is included in all registers of green areas. Currently, there are objects there that the SACI and the Kyiv City State Administration and other officials consider legal. These are residential buildings. Does this correspond to the intended purpose, the functional purpose of this site? No, it doesn’t. It is no longer the Pokol tract, it is the Beton tract. It has no social
infrastructure, no engineering infrastructure. This is what we call «Concrete Mordor». And this «Mordor» is made by Vitali Klitschko’s right hand man, Igor Nikonov. His company designed it.

I don’t know what other documents need to be brought to the courts if there are official extracts from official cadastres. The SACI register clearly shows the intended purpose of this site – a hotel, office and shopping complex. How can this be in a country that follows the European path of compliance with the law? It is clearly written – there is public development and residential development. What kind of office and shopping complex is this, if you see an insane amount of residential development? This is a fake document! This is forgery of documents! This is providing false information! These are articles that should be investigated by the prosecutor’s office. The National Police pretends to be investigating. Investigators have been trying for several years to demand the documents. But there are defendants in the criminal proceedings. The most interesting thing is that the defendants – the Nikonov firm – deny any involvement in the design.

A building license is an official document issued by the State Architectural and Construction Inspectorate. We say «authorities», «DABI», «KSCA». These are incomprehensible names. The permit has a clear signature of Mr. Tkachuk. This is a gibun – the chief inspector of building supervision (abbreviated as «gibun»). These gibuns are creating lawlessness, and we are told by the prosecutors and the police that they are all defenseless and helpless. This is the result of reforming the construction industry in less than seven years! And this must be stopped. We need to come out as a powerful united public force and stop the lawlessness. After all, there are officials who are criminally liable.

This is the DABI together with the so called experts. You all know that every construction project must have state documents with monograms. 22 residential buildings on the recreational lands of the Pokol tract is a crime. We need to call a spade a spade. But the perpetrators of the crime – what an insane number of round seals of experts! These are experts who are qualified and licensed by the Ministry of Regional Development. I have a question for the representatives of the Ministry of Regional Development: When will we revoke this illegal transfer of the certification procedure for experts, architects, and builders to some ephemeral organizations? All of them are certified and all of them have shown that there are no violations. And the customer handed over their experts, who wrote that there were no violations of the rules and laws. And the customer writes to the Ministry of Regional Development: “We ask for permission to deviate from state building codes.” What did the experts submit, saying that there were no violations? And the customer writes, «We have a huge number of violations. I have a question: is something wrong in this country? Why is the one who is supposed to stop criminals in the middle of it? Why are these things happening today? In the SACI document, some local government official, who was granted the right under the law on decentralization, decides that he or she can be guided by some deviations provided by the Ministry of Regional Development! It was granted in 2015.

This has already dried up the blood on Instytutska. But in 2015, we suffered our biggest losses at the front. When some were fighting and shedding blood there, others here in the rear were waging a partisan war against their own people! And here we are – this second front, which the community has been holding for these years, justifying ourselves that we are not thugs, we are not bought, we are not fools, we are not “city madmen”, we are simply for truth, for law, for adherence to norms in the end.

Anti-corruption bodies have proliferated so much that I am already confused by their names. Look at the violations – there is no insulation in these buildings (this is about protecting investors rights). Experts say there are no violations. The developer himself says we cannot build, sell, or put into operation with such violations. Stairs and marches – violations of fire regulations, lack of sanitary insulation…

But I wanted to focus your attention on the text from 2010 for the final time. This is an article in Mr.Karpuntsov’s newspaper, the right hand of Vitaliy Klitschko. In 2010, he was talking about how they – the opposition – were fighting to preserve Pokol Park. And then, after coming to power in the blood of the Revolution of Dignity, all this Strike struck us with you. Struck our city. Struck at the most painful, at the very heart, destroying greenery and turning the city into “Concrete Mordor”. You must know your enemies in person. I only showed a tiny part.

Support my appeal: dismiss all chief building inspectors and announce a competition to fill vacant positions; Minregion and DABI to develop a new procedure for state architectural and construction supervision; cancel the validity of Minregions approval letters for deviations from building norms issued for objects before 2017; dismiss the chief architect of Kyiv and deputy mayors of KMDA in charge of urban planning, land use, capital construction, state architectural and construction control and submit applications for the initiation of criminal proceedings against them.
